What is Family Law?

Unless you have been through a family law matter, you might not know what the term “family law” means.

Family law means any matter involving the creation, addition, exclusion, or destruction of the family. Today’s definition of family is quite is complicated, because we may have grandparents, aunts and uncles, partners, step-parents, step-siblings, foster parents, and adoptive parents involved with the children. Child-related issues include matters of custody or conservatorship, parental rights and duties for the children, possession and visitation rights for the children, child support amounts, and other related rights, privileges and commitments. Family law may also involve adoption, determination of paternity, pre- and post-marital agreements, same-sex relationship matters, protective orders, and grandparent rights. Furthermore, once orders are put into place, they periodically need to be changed, modified, revoked, or enforced. We can help you through all of these issues.

How do you choose your family law attorney?

Due to the emotionally charged nature of family law and the frequent need to represent issues in open court, this is a difficult field for many lawyers to practice. Many attorneys simply refuse to handle such cases. The challenge is to find a lawyer who is confident in court, who has critical people skills to help the client through this difficult time, and the creative ability to work towards the best solution for the client. A good family law attorney knows when it is necessary to go to court, and when matters are best handled outside the courtroom.

You need to ensure that your attorney is comfortable handling such highly-charged cases. You also need to be sure that you are comfortable with the attorney’s personal style. For example, though you want a confident attorney, you should be careful of hiring a “pit-bull” attorney, because that type of attorney is also likely to bully you, and cost you more in long, drawn-out court battles.
