Family Law
A major focus area at our office is family law. We handle a full range of cases, including:
Divorce
Texas allows for many types of divorce, including no-fault, at-fault, uncontested, collaborative and mediated divorce. We can help guide you through the process, keeping your best interests and those of your children at the forefront. We will help you determine separate and community property and debt, and divide community assets and liabilities equitably. We can also find creative solutions for dividing difficult assets, such as houses, retirement accounts, and vehicles.
Adoption
We are familiar with Texas and Federal laws regarding adoption. It's important that adopting and placing parents, as well as those searching for family members, learn what these laws allow and don't allow.
Child Custody/ Conservatorship
Instead of "custody", Texas uses the term "conservatorship". Either or both parents (or a 3rd party) can be granted conservatorship. Conservatorship includes not just where the child resides and visitation, but also decisions including the child’s education, religious upbringing, and health care. We can help you obtain the appropriate type of conservatorship of your children. We can also assist with termination of parental rights.
Child Support
Child support guidelines are set forth in the Texas Family Code, and the amount of payment is determined by both the Code and a variety of social, economic, and professional factors. We work with you to estimate appropriate amounts, and ensure that the monies are paid in the appropriate manner.Grandparent RightsFamilies crumble for any number of reasons: divorce, the death of a parent, drug and alcohol abuse, incarceration. Grandparents may have rights and can seek visitation with or custody of grandchildren.
Paternity
Establishment of paternity is critical for the purposes of obtaining child support, visitation and custody. We help you to establish or disprove parentage and secure your rights.
Visitation
Texas has a standard visitation order, but we can assist you in creating a more suitable visitation schedule should the standard not suffice.
Same Sex Relationships
Although Texas does not recognize same sex marriages, we can help you create binding agreements for the purposes of prenuptials, post nuptials, estate planning and child custody. We also have experience with adoption into same sex families.
Property Agreements
We can help you create prenuptial and post nuptial agreements, whether you are entering a traditional marriage or a non-traditional relationship.
We also handle modifications and enforcement for all of these issues.
Estate Planning and Probate
Estate planning includes the process of anticipating and arranging for the disposal of an estate. Usually this is associated with wills, trusts and the probate of estates, including estates without a will. Yet this also includes guardianships, powers of attorney and medical directives. We ensure that your wishes are documented and enforceable, not only after your death, but before as well.
Criminal Law
We handle misdemeanors, including but not limited to traffic tickets, DUI and DWI.
